Government Contracts and Grants
The huge number of federal and state government contracts and grants available under the Recovery Act provides enormous opportunities. However, all Recovery Act funds come with a complicated set of strings attached. Among other things, the Act includes a complex new Buy America provision and imposes many other restrictions for specific programs. The administration is quickly issuing supplemental regulations and policies concerning Recovery Act funds. In addition, contractors and subcontractors subject to the Federal Acquisition Regulation (FAR) must comply with all FAR and agency-specific regulations, including a new FAR provision that imposes compliance program requirements. Moreover, all contractors, subcontractors, grantees and sub-grantees must comply with a new “mandatory disclosure” rule requiring timely disclosure of “credible evidence” of criminal violations, violations of the civil False Claims Act or significant overpayments received.
Companies receiving Recovery Act funds must keep abreast of these fast-changing regulations and requirements and ensure their practices are in compliance. Among other things, almost all companies will need to update their compliance programs and practices to ensure they meet the requirements of the new mandatory disclosure rule.
